    1. Understanding these Player Terms

    1.1. These player terms and conditions ("Player Terms") describe how you may: (i) access and use the MobInc Services and the content on it; and (ii) interact with the MobInc Services by (for example) registering for an Account (as described below), playing our Games, submitting comments, images, videos or any other type of material.

    1.2. By using the MobInc Services you confirm that you accept the Player Terms and that you agree to comply with them. These Player Terms also include the following, which you should read carefully:

    1. Privacy Policy (see Section 9)
    2. Game Rules (see Section 3.2)
    3. Bonus and Promotion Terms (see Section 6)

    1.3 If you disagree with any part of these Player Terms, you should not register for an Account (or should immediately close your Account) and should not use the MobInc Services or play our Games.

    1.4. We reserve the right to modify these Player Terms from time to time for a number of reasons, including but not limited to the need to comply with applicable laws and regulations. We will make any revised Player Terms available on the MobInc Services, and will notify you of any material changes to the Player Terms either through the contact details you provide us when registering for an Account or by placing a notice on the MobInc Services. If you do not agree to the updated Player Terms you should stop using the MobInc Services immediately.

    1.5. When certain words and phrases are used in these Terms of Use, they have specific meanings (these are known as "defined terms"). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the section of these Player Terms where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks).

    1.6. When we refer to "Player", "you" or "your" we mean you, the person accessing or using the MobInc Services.

    2. Your Account

    2.1. Opening an Account. To play our Games for cash prizes you will first need to register for a player account on the MobInc Services ("Account"). To open an Account you must complete the registration form on our MobInc Services and provide us with certain information about you, including your name, address, mobile number, email address and date of birth.

    2.2. As part of the registration verification process you are required to provide a valid email address. A Registration Confirmation email will be sent to the email address provided. To login for the first time you will need to click-through from the link provided in this email. If you don’t receive the Registration Confirmation email or you wish to amend the email address provided when Registering please contact our Customer Support Team: [email protected]

    2.3. By completing and submitting our registration form to open an Account you create a legally binding contract between you and MobInc. You also agree that:

    1. you are over 18 years of age (and it is important you also understand that underage gambling is illegal);
    2. you are resident in the United Kingdom (gambling may be illegal if you are resident in other countries);
    3. the information you have provided on registration is current, complete and accurate. If your circumstances change and/or you become aware that any information provided is no longer current, complete and/or accurate then you should notify us immediately by contacting Customer Support;
    4. you are the true and lawful owner of any money you deposit in your Account;
    5. you are aware that you might lose the money you wager as a consequence of playing the Games;
    6. you may use your Account solely and exclusively in your personal non-professional capacity for recreational and entertainment purposes only and not for any commercial, financial or other operations;
    7. you are not acting on behalf of any other person;
    8. this is the only Account you have opened;
    9. you are not physically located at the time of playing any Game in any territory that we exclude at the time of registration, including, but not limited to, the United States of America;
    10. you will not do anything to seek to circumvent any technological or other measures we have in place during the registration, Game playing and/or deposit processes to prevent persons located in excluded territories from registering for an Account and/or playing our Games;
    11. you are not an employee of MobInc or any of its group companies or a member of any such employee's immediate family; and
    12. you are not a person prohibited from participating in games by the Office for Foreign Assets Control of the US Department of the Treasury and/or any comparable governmental body or department in any other country that may prohibit persons in a manner similar to the Office of Foreign Assets Control.

    2.4. In order to secure your Account, you will also be asked to choose a unique password, which will be used with the provided email to login to your Account. When creating a password, you must avoid using terms or phrases that, in our discretion, could be considered vulgar or offensive, or infringe any trademark or proprietary rights of a third party.

    2.5. It is your responsibility to keep your Account details and password secure, and you must not disclose these details to any third party for any reason. In the event that you lose or forget your Account login details, you can retrieve them by using the 'forgotten password' link on the sign-in page.

    2.6. As a consequence of your applying to register for an Account with us, you agree that we may verify your identity and the accuracy of the information provided on the registration form, including without limitation by requiring further information and/or proof of identity from you, and may pass your information on to third parties (including credit reference agencies) in order to do so. Failure to provide satisfactory verification information and/or proof of identity to us on demand may lead to your Account being suspended or terminated. In addition, you will not be able to deposit any funds to your Account and/or play any of our Games (including on a free basis or using any Bonus funds) until we have been able to verify that you are over 18 years of age.

    2.7. We reserve the right in our absolute discretion to refuse any application for registration and are not obliged to provide a reason for any such refusal.

    2.8. You agree that you are responsible for any use of your Account by a third party where such use is permitted or authorised by you or due to your fault or negligence. We are entitled to assume that any MobInc Services activity using your Account has been carried out by you where your password and login information has been correctly supplied, unless you are able to demonstrate to our reasonable satisfaction that use of your Account by a third party was neither permitted nor authorised by you nor due to your fault or negligence. We will not be responsible or liable to you for any loss that you may incur as a result of misuse of your password, and we accept no responsibility or liability resulting from its use by a third party, where you are unable to demonstrate to our reasonable satisfaction that such use is not: (i) permitted or authorised by you; or (ii) due to your fault or negligence.

    2.9. Closing your Account. You may suspend or close your Account at any time by contacting Customer Support at [email protected]. For more information on temporarily and permanently excluding your account please see Section 5.2 below. Please see Sections 2.10 and 8 below for our rights to suspend and/or terminate your Account.

    2.10. Duplicate Accounts. You are only allowed one (1) Account per address, per mobile or desktop device or IP at any one time. If two (2) or more Players share the same address, mobile or desktop device or IP and wish to open an Account, they must contact Customer Support in advance. We also do not allow multiple Accounts to be opened with different email addresses and/or different names where the intention is for those Accounts to be used for the benefit of the same person. If, in our opinion, you have more than one Account ("Duplicate Account") we may: (i) keep your Account and Duplicate Accounts open while an internal investigation is in process; (ii) close your Account and all of your Duplicate Accounts; and/or (iii) keep open the first Account opened by you or on your behalf and delete all Duplicate Accounts. If we close any Account or Duplicate Account in these circumstances:

    1. all bonuses and winnings accrued from such bonuses obtained using that Duplicate Account will be void and forfeited by you;
    2. we may, at our entire discretion, withhold some or all of the balance of the Duplicate Account in accordance with Section 8.3, and to the extent that the balance of the Duplicate Account is not sufficient to recover any amounts due to us by you in respect of a Duplicate Account, may recover such sums from your Account and/or any other Duplicate Account; or
    3. we may, at our entire discretion, allow usage of the Duplicate Account to be deemed valid in which case all wagers placed by or for you through the Duplicate Account shall be retained by us and the balance of any amount remaining in the Duplicate Account which was deposited into the Duplicate Account by you (if any) will be refunded.

    2.11. Dormant Accounts. If you have not logged in to your Account for a continuous period of at least 12 months your Account will be considered 'Dormant'. If you have funds in your Account at this point we will contact you using the contact details associated with your Account to inform you of how to reactivate your Account or how to withdraw any cash balance in your Account.

    3. Playing our Games

    3.1. Some of our Games may be made available to you to play for free if you want to try them before you place a wager and play for cash prizes. It will be clearly displayed on the applicable Game page if you are able to play for free. If you want to play for cash prizes you will need to use the funds in your Account to place a wager.

    3.2. The game rules that apply to each individual Game ("Game Rules") are available on the applicable Game page of the MobInc Services. You should make sure you understand the rules of each Game before you place a wager on that Game.

    3.3. When playing our Games for cash prizes you are able to bet or wager up to the amount of available funds in your Account balance.

    3.4. When you click to place a bet or wager and play a Game, the amount of the wager will be deducted from your Account immediately, and the Game will be made immediately available to you. As such, except as expressly set out in these Player Terms, we are unable to provide refunds, return of monies, or cancellation of the confirmed bet or wager once it has been placed.

    3.5. You must check that the bet or wager instructions you submit, and in particular the amount you are betting or wagering, are correct before confirming the bet or wager.

    3.6. Your transaction history is available at all times through the My Account section of the MobInc Services.

    3.7. At all times, where these is a disagreement as to the details of any bet or wager placed through the MobInc Services or the outcome of any bet or wager, the record maintained by us through our systems shall prevail unless you dispute such record in accordance with Section 10 below.

    3.8. All cash winnings will be credited directly to your Account cash wallet. All bonus winnings will be credited directly to your Account bonus wallet.

    3.9. In the event of a game interruption due to network connectivity, a game malfunction or other anomaly which interrupts the flow or game play, your initial bet or wager will be refunded and the bet or wager voided.

    4. Deposits and Withdrawals/Protection of your Funds

    4.1. Deposits. In order to play our Games for cash prizes, you are required to make a cash deposit to your Account wallet using one of the payment methods available. We may change these payment methods from time to time. We cannot promise that all payment methods will be available at all times to all Players depending on certain factors including internal decision. For more information on which payment methods are currently available, please visit the Deposit section of the MobInc Services when logged in.

    4.2. The name on the card or the bank account or any other payment method used to deposit to your Account should be identical to that of the Account holder. If we identify that funds have been deposited to your Account from a third party, we reserve the right to immediately return the deposit back to the source and void any winnings that have arisen from such a deposit. Any charges levied by the banks and/or payment gateways may be deducted from the reversed amount. If we have reason to believe that the transaction may not have been authorised by the owner of the applicable card/bank account/other payment method (for example, if we believe the payment card is stolen) then we may immediately suspend your Account, and may refer the incident to the relevant authorities.

    4.3. Your Account is not a bank account and cannot be used as such. Any monies deposited with us in your Account shall not bear any interest to you. Any and all funds deposited by you must be used for the sole purpose of gambling and the deposits made by you should reflect the level of your gambling activity through the MobInc Services.

    4.4. We reserve the right to set minimum and maximum deposit amounts from time to time. The minimum deposit amount is £5.

    4.5. At the time of making your first deposit (and subsequently) you can also choose to set Net Deposit Limits (or if we have set a maximum net deposit limit, one that is lower than the standard amount). For more information see the Responsible Gambling section below.

    4.6. Deposits made using your mobile phone bill are subject to the following rules:

    1. you can only deposit from a mobile phone number that has been confirmed in your Player Account.
    2. you are allowed a maximum of two (2) confirmed mobile numbers in your Player Account for the purpose of making deposits at any one time.
    3. you are able to deposit a maximum of £30 per day via mobile billing, or other limits set by your mobile network or the regulatory body Phone-paid Services Authority.
    4. if we are advised by your mobile network operator of non-payment, misuse or if payment is withheld by your operator or we suspect any of the actions stated above, we may suspend or terminate your Account and any winnings will be forfeited.
    5. upon completion of a successful deposit you will be sent an SMS confirming your deposit. Please retain a copy of this notice of transaction for your records.
    6. you are able to update your mobile number a maximum of one (1) time every thirty (30) days.

    4.7. We do not accept cash funds or cheques sent to us as an acceptable form of deposit. Any funds received by this method will be returned to the sender. If it is not possible to return to the sender, the funds will be donated to a charity of our choosing related to the gambling industry.

    4.8. By depositing money into your Account you represent to us that the money you deposit does not originate from any illegal activity or source.

    4.9. If the payment to us of any funds requested to be credited to your Account is stopped, returned or otherwise not completed for any reason, or if any such payment is subsequently cancelled or discovered to have been the subject of any theft or fraud, we may immediately deduct any amounts credited to your Account in respect of the payment, together with any reasonable charges incurred by us with respect to any such payment.

    4.10. Making a withdrawal. Without prejudice to Section 4.3 above and subject to the following provisions, you may request to withdraw any unspent winnings credited to your Account at any time. A payout of any amount that has been deposited in your Account, which has not been used to play Games may generally not be requested by a Player in accordance with our AML Policies.

    4.11. We are required to carry out verification procedures to comply with anti-money laundering and other laws. Prior to a withdrawal being approved and a payment being made we may require you to submit additional identification documents for these purposes. If you do not comply with these requests so that we can adequately identify you, we will not be able to pay you your winnings. Please be aware that these procedures take time and may, therefore, increase the amount of time it takes us to process your withdrawal request.

    4.12. Any withdrawals over £50,000 might be subject to additional AML checks which could impact the time taken to complete the withdrawal process.

    4.13. In accordance with anti-money laundering regulations, where possible, withdrawals must be paid back to the same payment option used by a Player to deposit funds. Where this isn’t possible, for example when payments are made using Mobile Billing, MobInc may permit the use of direct bank transfer once any necessary identification documents have been supplied and verified. In instances where bank transfer is used to withdraw funds, you accept that the withdrawal process may take up to 7 working days

    4.14. MobInc may charge a fee for handling payments by bank transfer. If for any reason we are unable to process your withdrawal to your selected payment method then the requested withdrawal will be returned to your Account.

    4.15. If your Account is credited with winnings that do not belong to you, whether due to technical, human or other type of error, the funds will remain the property of MobInc and we may automatically remove such funds from your Account. If, prior to MobInc becoming aware of the error, you have withdrawn funds that do not belong to you, without prejudice to other remedies and actions that may be available at law, the incorrectly paid amount will constitute a debt owed by you to MobInc. In the event of an incorrect crediting, you must notify us immediately by contacting Customer Support.

    4.16. Segregation of your funds. In accordance with the requirements of the British Gambling Commission for the segregation of customer funds, MobInc does not protect customer funds held with us. This means that these funds are held in bank accounts separate from our business accounts but would form part of the assets of the business in the event of our insolvency. Whilst efforts will be made to safeguard your money, there is no guarantee that all funds would be repaid in the event of insolvency. Click here for more information.

    5. Responsible Gambling

    5.1. Whilst most Players are able to enjoy their gaming experience, we believe that it is our responsibility to ensure that you have a safe and enjoyable experience while using our MobInc Services, whilst at the same time being aware of the social and financial risks associated with problem gambling.

    5.2. We provide a range of services to assist and support you if you feel that you are developing a dependency towards gambling. These services are made available to you via our Responsible Gaming page and cover the following areas:

      1. Setting Net Deposit Limits – We offer you the ability to set net deposit limits on your Account. This tool allows you to limit the amount of funds you can deposit over a certain time period. Once you've set the limit you can only deposit up to that value throughout the chosen time period. It's important to remember that any withdrawals processed in this time period are also factored into the calculation. That means you can deposit an amount equal to the value of the withdrawals in the time period made and then up to the set net deposit limit. You may set these net deposit limits any time on the following time periods: Daily, Weekly and Monthly.     5.5. GAMSTOP is a national service that enables you to self-exclude from participating online gambling companies licensed in Great Britain.     5.8. Our liability in relation to Responsible Gaming. We cannot accept responsibility or liability if you continue to gamble on the MobInc Services by seeking to circumvent the measures you or we have put in place using the facilities set out above, for example by opening additional Accounts (or opening an Account after self-excluding) or by using false registration details. Please be aware that, if you do open any additional Accounts or open an Account after self-excluding in contravention of the measures we have put in place to protect you, any such Account(s) may, in our sole discretion, be treated as a Duplicate Account in accordance with Section 2.10 (even if such Account is the only Account you hold with us at the time).

    5.9. In the event that there are remaining funds in your cash wallet after you have self-excluded, we will do our best to ensure these funds are returned to you promptly. Prior to a withdrawal being approved and a payment being made we may require you to submit additional identification documents for these purposes if your Account and/or payment method has not already been verified. Following a self-exclusion, we will endeavour to cease sending all marketing materials to the Account immediately or, in any event, within 48 hours of the exclusion being confirmed.

    6.1. MobInc Services may offer you promotions from time to time ("Promotions"), through which you can obtain 'Bonus Offers' ("Bonus Offers") and/or free spins or games (from which you can win Bonus Offers) ("Free Spins").

    Bonus Offers and Promotions are intended to enhance your experience with the casino, but as certain restrictions apply to the use of such Free Spins and Bonus Offers, it is important that you fully understand the terms of each promotion before you participate.

    6.2. When Bonus Offers are awarded. Bonus Offers are awarded at the discretion of MobInc Services. Bonus Offers can be awarded as part of an ongoing campaign, for example, as a Welcome Deposit Bonus Offer. They can also be awarded as a result of a player interaction, for example, when you complete a Game Achievement. They can also be part of promotional campaigns, sent to registered players who have opted in-to receiving marketing via email and/or SMS.

    6.3. How to claim your Bonus Offers. Currently available Bonus Offers are displayed on the Promotions page when logged in to the Site. Information directly relating a particular Bonus Offer, such as the Wagering Requirement necessary to qualify for the Bonus Offer, the minimum deposit (if required), etc. will be accessible from the Promotions page.

    To claim a Bonus Offer or Free Spins, you must click “Activate” on the Bonus Offer and follow the instructions.

    You will have a set amount of time to claim Available Bonus Offers, including those awarded as a result of an onsite achievement, and a separate set amount of time to qualify activated Bonus Offers. The time left to claim or qualify will be displayed as a countdown timer against each Bonus Offer located on the Promotions page.     6.4. Example Bonus Offer Formats. Below are examples of the different types of Bonus Offers that might be made available to you. Given that Bonus Offer and Promotion formats are subject to change, please always consult the associated terms before claiming an offer.

    Deposit Bonus Offer: A Bonus Offer which requires a minimum deposit to be placed before it can be claimed. Cashback and the Welcome Deposit Bonus Offers are examples of Deposit Bonus Offers. Deposit Bonus Offers may award a Bonus Offer as a percentage of the next deposit. For example, activating a 50% Bonus Offer by depositing £20 will award you a £10 Bonus Offer.

    Non-Deposit Bonus Offer: A Bonus Offer which does not require a deposit to be placed before it can be claimed and can be activated immediately. Achievements are an example of promotions which award Non-Deposit Bonus Offers.

    Minimum Deposit Requirement: Some Bonus Offers may only be activated upon placing a successful deposit with the Bonus Offer applied in the cashier. Minimum Deposit Requirements may vary but will be displayed on each Bonus Offer.

    Wagering Requirements: Where indicated, Bonus Offers are subject to Wagering Requirements which are displayed on Bonus Offers located on the Promotions Page as well as in the Promotions terms. Wagering Requirements can also be found on pages dedicated to a particular Promotion. Each Bonus Offer shows the amount that you need to wager to claim your Bonus Offer. Only wagers with cash funds will contribute toward the Wagering Requirements of a Bonus Offer, which means that you have to wager the value of the Bonus Offer a certain number of times using your cash. Once you have completed the Wagering Requirements of your Bonus Offer it will convert to cash and be credited automatically to your cash balance.

    Bonus Offer Activation Time: A Bonus Offer made available to claim in your Account will be displayed in the Promotions section with a countdown timer. This time details how long you have to activate your Bonus Offer before it expires and is no longer available to claim.

    Bonus Offer Completion Time: Activated Bonus Offers will be displayed in the ‘Bonuses’ section of the Promotions page with a countdown timer. The time displayed on this countdown timer is separate and independent to the Bonus Offer Activation Timer and details how long you have to fulfil the Wagering Requirements of the Bonus Offer before it expires.

    Maximum Bet Size: A maximum cash bet size may be applied when contributing toward an Active Bonus Offer. Exceeding this bet size will not affect your cash wager, including any winnings obtained as a result of the bet, however, your Bonus Offer may be subject to forfeiture.     6.6. Bonus Offer Statuses. There are four different stages to a Bonus Offer as follows:

    Available: An available Bonus Offer will be displayed in the Bonus Offers section of the Promotions page. Bonus Offers must be activated by clicking ‘Activate’ and, if required, meeting the deposit requirements displayed on the individual bonus.

    Active: Bonus Offers become Active as soon as they are claimed, with all wagers directly contributing toward the wagering requirements, subject to qualification requirements. You can check how far you are through completing a particular Bonus Offer from the Promotions page.

    Pending: You may only hold one Active Bonus Offer on your account at any one time. Any Bonus Offers you claim while already holding an Active Bonus Offer will be listed as a Pending Bonus Offer until you either begin the cash wagering requirements, you cancel the Bonus Offer, or it expires.

    Fulfilled: In the event that all qualification requirements (see section 6.5) have been met, the Bonus Offer will be considered fulfilled and the value of the Bonus Offer will be credited to your cash balance.

    Revoked: If one of the following occurs an Available, Active or Pending Bonus Offer can be revoked and removed from your Account: (a) You have not met the Wagering Requirements within the period specified in the Promotion; (b) You are found to be in breach of these Terms and Conditions or the terms and conditions associated to the specific Promotion; or, (c) You Self-Exclude or close your account.

    6.7. Cash Wagering Requirements. The Wagering Requirements are defined as the total value of cash bets/wagers you must stake before the Bonus Offer is qualified.

    All cash winnings generated from cash wagers will be placed in your Cash Wallet and can be withdrawn at any time.

    For the avoidance of doubt, at no time are funds from Available, Active, Pending or Revoked Bonus Offers made available for wagering. If the qualification requirements of a Bonus Offer have been Fulfilled, the value of the Bonus Offer will be converted into cash and automatically placed into your cash funds available for wagering and/or withdrawal.

    The Wagering Requirements for each Promotion will be clearly set out in the terms relating to the individual Promotion and will be expressed as a multiple of the value of the Bonus Offer.

    For example, if a £10 Bonus Offer is subject to a 30x Wagering Requirement, this means that £300 (£10 x 30) will need to be wagered in cash before your Bonus Offer is considered fulfilled. You may continue to deposit and withdraw from your account during this time without the risk of losing your Bonus Offer.

    For the avoidance of doubt, cash funds deposited in to your wallet will not be subject to any further qualification restrictions. However, any Bonus Offer that is currently Active or Pending may be subject to restrictions based on your cash wagering.

    6.8. Deposits and Withdrawals. Cash funds deposited to claim a Bonus Offer, and any winnings obtained as a result of wagering these funds, will directly contribute toward the wagering requirement of the Bonus Offer.

    You may continue to deposit while holding an Active Bonus Offer. Furthermore, any funds deposited in addition and any cash winnings yielded from the deposit funds will contribute toward the wagering requirement of the currently active Bonus Offer.

    You may also submit withdrawal requests without forfeiting any Active or Pending Bonus Offers in your Account.

    6.9. Multiple Bonus Offers. It is possible for you to hold more than one (1) Bonus Offer on your Account. Bonus Offers are activated in sequence from the order they were claimed. For example, you can claim Bonus Offer 1, Bonus Offer 3, then Bonus Offer 2 without activating Bonus Offer 1. At this time, all 3 Bonus Offers are considered to be Pending. At the point of a cash wager being placed, in accordance with all other promotional terms, this cash wager will contribute towards the wagering requirement of Bonus Offer 1, which is now Active. Upon either meeting the wagering requirements or cancelling Bonus Offer 1, Bonus Offer 2 will become the next Bonus Offer to be Active, and so on.

    6.10. Fulfilling Bonus Offers. When the Wagering Requirement of a Bonus Offer has been completed the Bonus Offer will be considered fulfilled. At this point the Bonus Offer will be automatically credited to your cash balance in accordance with the terms of the Promotion. Fulfilled Bonus Offers are available for immediate withdrawal.

    6.11. Wagering Contributions of Bonus Offers. Cash bets/wagers will contribute to the Bonus Offer Wagering Requirements at a different rate for each game type as follows:

    Without prejudice to Section 6.12(b) and (c), if you place a wager using funds from the Cash Wallet when a Bonus Offer is Active, the maximum value of all bets/wagers placed in any single round of a Game should not be greater than 20% of the value of the original Bonus Offer awarded. If you place a wager using the funds from your Cash Wallet that is higher than 20% of the value of the original Bonus Offer awarded, we may (in our sole discretion) decide that only 20% of the value of the original Bonus Offer awarded will contribute towards the Promotion wagering requirements or withdraw your eligibility for a Bonus Offer or remove any Bonus Offers currently pending or active in your Account in accordance with Section 6.12(b) and (c).

    If a 'Welcome Bonus' is active, then the maximum value of all bets/wagers should not be greater than the lesser of: (i) 20% of the value of the Welcome Bonus; and (ii) £10.

    6.12. Restricted Behaviour. If you engage in any of the following conduct, we may withdraw your eligibility for a Bonus Offer (and your eligibility for any future Bonus Offers) and may remove any Bonus Offers currently pending or active from your Account. For clarification, your cash balance itself is not subject to any restrictions, however, engaging in the following restricted behaviour using funds from your cash balance while a Bonus Offer is Active may result in your Bonus Offer being removed.

    a) Placing stakes in a manner that aims to ensure that 90% or more of those stakes are recouped in winnings, with the intention of increasing the wagering volume with minimal win/loss expectancy. For example (but not limited to), placing bets on red and black and the green zero or covering the majority of the table on roulette;

    b) Notwithstanding Section 6.11, except if you are playing with any 'Welcome Bonus' (in which case, see (c) below), placing single or multiple cash stakes of a value of twenty percent (20%) or more of the original Bonus Offer amount (including via the use of in-game mechanics that allow you to gamble winnings awarded from a previous spin) on any single game, individual hand, or round;

    c) Notwithstanding Section 6.11, if any 'Welcome Bonus Offers' is active, placing single or multiple cash stakes of a value of the lower of: (i) twenty percent (20%) or more of the original Welcome Bonus amount; and (ii) £10, (including via the use of in-game mechanics that allow a Player to gamble winnings awarded from a previous spin) on any single game, individual hand, or round;

    d) Building a balance and then significantly changing play patterns (stake size, game types, stake structures, etc.) in order to meet the Wagering Requirements; and

    e) Placing large stakes which result in a substantial gain followed by a drop in stake size equal to or more than seventy five percent (75%) of the previous average stake size until the Wagering Requirements have been met.

    We reserve the right to review your transaction records and game session logs from time to time in order to determine whether you have engaged in any of the prohibited behaviour outlined above.

    6.13. Opting Out of Bonus Offers. You may cancel your Bonus Offer(s) at any time before the Wagering Requirements are fulfilled from the Promotions page.

    7. Prohibited Activities

    7.1. We are committed to taking all reasonable measures to prevent anything that gives any Player an unfair advantage and/or threatens the integrity of our Games and systems. As a result, we prohibit certain behaviour, conduct and activities by Players in connection with the MobInc Services.

    7.2. The following behaviour, conduct and/or activities are prohibited:

    1. Cheating: Making any actual or attempted deception or interference in connection with the MobInc Services, including through the manipulation of any of our Games.
    2. Collusion: Attempting to gain an unfair advantage by sharing knowledge of your cards or other information with one or more other Players.
    3. Fraud: Any fraudulent activity in respect of the use of the MobInc Services, including fraudulent payment, for example if you use stolen credit cards, or initiate any unjustified chargeback or other reversal of a payment, or initiate any prohibited transaction (including but not limited to money laundering).
    4. Duplicate Accounts: As set out in Section 2.10 and/or 5.8, having Duplicate Accounts.
    5. Extracting player profiles: Any use of programs (or information derived from them) created to extract player profiles and obtain information in respect of those players' game play in order to gain an advantage when playing against those players.
    6. The Use of "BOTS": Any use of programs ("BOTS") specifically created to play a game in place of an actual (human) player and conceal its use from both us and other Players. All actions taken in relation to the MobInc Services by a Player must be carried out personally by you.
    7. Intentionally delaying the outcome of and/or "timing out" of a Game: Any attempt to deliberately delay the conclusion of and/or the determination of the result of a Game, including by intentionally "timing out" of a Game.
    8. Exploiting loopholes and/or errors: Any exploitation of a fault, loophole or error in our software or software provided by third parties covered by these Player Terms.
    9. Transferring funds from one Player Account to another: Any attempt to transfer funds from your Account to any other Account.

    7.3. If we suspect that you have carried out or have otherwise been involved in any of the prohibited activities set out in this Section 7, then the remedies set out in Section 8 will be available to us.

    8. Our Rights

    8.1. Suspension and termination of Accounts. We may immediately suspend or terminate your Account if we reasonably consider that you have breached any of these Player Terms.

    8.2. We may, in particular, suspend or terminate your Account if:

    1. we reasonably suspect that you have engaged in any cheating, colluding or other fraudulent or illegal activity in respect of the MobInc Services, your Account and/or the Games and/or have carried out or been involved with any of the prohibited activities set out in Section 7.
    2. you have provided any false or misleading information;
    3. you have failed to provide any documents requested in order to verify your identity within a reasonable timeframe; and/or
    4. if you are in breach of any of the representations given in Section 2.3.

    8.3. If we terminate your Account for any of the reasons set out in Sections 8.1 or 8.2 above, we will notify you by email and will be entitled to withhold any balance on the Account (including any winnings) to the extent required to compensate us for any losses caused by your breach of these Player Terms or any other act or omission giving rise to our right to terminate your Account. If the Account has been closed because we have determined that you are under 18 years of age, any funds deposited into the Account by you, less the amount of any winnings withdrawn from the Account, will be returned to you in accordance with the withdrawal section of these Player terms.

    8.4. We may also close your Account for any reason by giving you notice by email of such closure.

    8.5. We reserve the right to refuse the whole or part of the transaction requested by you, or to limit the amount of wagers that you may place through your Account, at any time in our sole discretion.

    8.6. We may cancel any wager placed and/or withhold the amount staked and/or withhold any winnings in respect of any wager if we reasonably suspect that you have engaged in any of the activity described in Section 8.2.

    8.7. Report and Notifications. We may make a report to any relevant authorities regarding your behaviour in respect of any of the gambling services we offer, including the British Gambling Commission, the British police and/or the UK National Crime Agency, the Maltese Financial Intelligence Unit, the Malta police and the Malta Gaming Authority. Please note that persons knowingly in breach of these Player Terms may be subject to criminal proceedings.

    10. Contacting Us & Complaints

    10.2. Following the lodging of a complaint with our Customer Support team, the following steps will be taken by us in a timely fashion:

    1. Our Customer Support team will investigate your complaint and aim to resolve the matter in a manner that is fair and objective;
    2. If, after this process, you do not feel that the matter has been dealt with to your satisfaction, then you may request that the complaint be escalated to a member of our senior management team for a second stage review;
    3. If you feel that, after this second stage review, the complaint still has not been brought to a satisfactory conclusion:
      1. if your complaint relates to the outcome of a gambling transaction, you may contact MobInc’s Alternative Dispute Resolution (ADR) provider ADR Group in accordance with Part 4 of 2015 No. 542 Consumer Protection. This may happen at such time as we have exhausted our internal complaints handling procedure and have been unable to settle the complaint. ADR Group will competently deal with that complaint should you wish to use alternative dispute resolution. We will be obliged, or prepared, to submit to an alternative dispute resolution procedure operated by ADR Group. ADR Group can be contacted by clicking here.       2. if your complaint does not relate to the outcome of a gambling transaction, you may contact your local Citzens' Advice Bureau for further information in relation to your rights or dispute our decision in accordance with Section 10.3.

    10.3. Governing Law and Jurisdiction. These Player Terms shall be governed by and construed in accordance with English law. Any dispute arising out of or in connection with these Player Terms shall be subject to the jurisdiction of the courts of England, unless you choose the courts of your home in another Member State of the European Union. We retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.

    11. Our Liability

    11.1. Nothing in these Player Terms excludes or limits our liability for:

    1. death or personal injury caused by our negligence;
    2. fraud or fraudulent misrepresentation; and
    3. any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

    11.2. Subject to Section 11.1, we exclude liability (whether arising in tort, contract or otherwise and whether or not due to our negligence) for any direct, indirect or consequential loss or damage which you or any third party may suffer as a result of:

    1. viruses, bugs or other technologically harmful material that may infect your computer equipment, computer programs, other hardware (including mobile phones or tablets) or other material due to your using or downloading any content via the Games;
    2. any loss of your content or data caused by your accessing the MobInc Services or the Games; and
    3. any misrepresentation on or relating to the MobInc Services or the Game.

    11.3. Subject to Section 11.1, MobInc’s maximum aggregate liability to you in respect of your use of the Games, the MobInc Services and your Account shall be an amount equal to:

    1. if the liability relates to the playing of a Game, the amount wagered on that applicable Game;
    2. if the liability relates to the misapplication of funds, the amount of money which was in your Account which has been misapplied; and
    3. in respect of any other liability, an aggregate of £5,000.

    11.4. Except in the circumstances described in these Player Terms whereby we may withhold payment of your winnings or other amounts from your Account (for example, pursuant to Sections 2.10 and 8.3) nothing in this Section 11.4 is intended to limit our obligation to return to you any unused deposits or accrued winnings in your Account.

    11.5. We assume no responsibility for the content of MobInc Services linked to from the MobInc Services. Such links should not be interpreted as endorsement by us of those linked MobInc Services. We will not be liable for any loss or damage that may arise from your use of them.

    12. Intellectual Property

    12.1. We are the owner or licensee of all intellectual property rights in the MobInc Services and its content, including the Games and the MobInc name and mark. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.

    12.2. You are not granted any right to use, and may not use, any of our intellectual property rights other than as set out in these Player Terms. You must not use the MobInc Services (or any part of it or its content) for commercial purposes; however, you may download material from the MobInc Services solely for non-commercial, personal use by you.

    12.3. Subject to you holding a valid Account, you may access and play the Games on a non-exclusive, non-transferable, revocable licence basis for your own personal, non-commercial and entertainment purposes. Under the terms of this licence to use the Games you shall not: (a) attempt to reverse compile, disassemble, or otherwise reverse engineer any Game (or any element of any Game); (b) attempt to obtain, or assist others in obtaining, access to the underlying code of any Game, or take content from it; or (c) use the Games in any way that breaches these Terms, contravene applicable law or attempt to circumvent the spirit and intent of the provision of these Games.

    13. Use of the Apps

    If you use an App, the following terms will also apply.

    13.1. We grant you a non-transferable, non-exclusive licence to use the App on the compatible devices to which you download the App, subject to your compliance with the provisions of this Section 13.

    13.2. Except as expressly set out in this Section 13 or as permitted by any local law, you agree:

    1. not to copy the App except where such copying is incidental to normal use of the App, or where it is necessary for the purpose of back-up or operational security;
    2. not to rent, lease, sub-license, loan, translate, merge, adapt, vary or modify the App;
    3. not to make alterations to, or modifications of, the whole or any part of the App, or permit the App or any part of it to be combined with, or become incorporated in, any other programs;
    4. not to disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the App or attempt to do any such thing except to the extent that such actions cannot be prohibited by applicable law;
    5. to keep all copies of the App secure and to maintain accurate and up-to-date records of the number and locations of all copies of the App;
    6. not to provide or otherwise make available the App in whole or in part (including object and source code), in any form to any person without prior written consent from us; and
    7. to comply with all technology control or export laws and regulations that apply to the technology used or supported by the App.

    13.3. You must:

    1. not use the App in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the Player Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the App or any operating system;
    2. not infringe our Intellectual Property Rights or those of any third party in relation to your use of the App (to the extent that such use is not licensed by this Section 13);
    3. not use the App in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
    4. not collect or harvest any information or data from the App or our systems or attempt to decipher any transmissions to or from the servers running the App.

    13.4. For the purpose of this Section 13.4 "Appstore Provider" means the provider of the app store through which you have downloaded the App (for example, Apple is the Appstore Provider if you have downloaded the App from the Apple App Store, Google is the Appstore Provider if you have downloaded the App from Google Play, etc):

    1. You acknowledge and agree that this EULA has been concluded between you and us, and not with the Appstore Provider. You acknowledge and agree that the Appstore Provider is not responsible for the App and its content.
    2. You acknowledge and agree that the Appstore Provider has no obligation to provide any maintenance or support in respect of the App. Should you have any problems in using the App, please contact us at [email protected].
    3. The Appstore Provider shall, to the maximum extent permitted by law, have no obligation to you whatsoever with respect to the App.
    4. You acknowledge and agree that the Appstore Provider shall not be responsible for addressing any claims that you might have relating to the App, including (without limitation): (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
    5. In the event that a third party claims that the App infringes its intellectual property rights, we (and not the Appstore Provider) shall be solely responsible for the investigation, defence, settlement and discharge of such claim.
    6. You warrant and represent that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
    7. If the Appstore Provider is Apple, you acknowledge and agree that Apple and its subsidiaries are third party beneficiaries to this Section 13. Upon your acceptance of the Player Terms (including this Section 13), Apple will have the right to enforce the EULA against you as a third party beneficiary.

    14. Other Important Information

    14.1. Technical Requirements. It is your responsibility to ensure that you have an appropriate web browser and any other technical requirements required to access the MobInc Services, play the Games or use your Account. You are solely responsible for any connection, use or other charges levied by your network operator when you register to play the Games, access the Games and the MobInc Services, download software, place bets or communicate with us. These charges shall form no part of any wagers placed in the Games.

    14.2. We do not guarantee that the MobInc Services will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access the MobInc Services and we recommend that you use your own virus protection software.

    14.3. You must not misuse the MobInc Services by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the MobInc Services, the server on which the MobInc Services is stored or any server, computer or database connected to the MobInc Services. You must not attack the MobInc Services via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the MobInc Services will cease immediately.

    14.4. Assignment and sub-licensing. We may transfer, assign, sublicense or pledge these Player Terms, in whole or in part, to any person without notice, provided that any such assignment will be on the same terms, or terms that are no less advantageous to you.

    14.5. Severability. If any part of these Player Terms is deemed unlawful, void or for any reason unenforceable, then that part shall be deemed to be severable from the rest of these Player Terms and shall not affect the validity and enforceability of the remaining provisions of these Player Terms. In such cases, the part deemed invalid or unenforceable shall be amended in a manner consistent with applicable law to reflect, as closely as possible, our original intent.

    14.6. Entire Agreement. These Player Terms shall apply between us in respect of the matters described herein to the exclusion of all other terms (except for any information provided on the MobInc Services, but including any terms and conditions that you purport to apply). You shall not be entitled to rely on any agreement, understanding or arrangement which is not expressly set forth in these Terms.
